TERMS AND CONDITIONS OF USE
1. INTRODUCTION
These Terms and Conditions shall govern your use of AMC One (the "Service") as provided by AMC Studios International B.V. ("AMC Networks"). Please review the below carefully and do not use the Service if you do not agree to any part of these Terms and Conditions.
2. LICENSE TO USE THE SERVICE
AMC Networks hereby grants you a non-exclusive, non-transferable, non-assignable, non-sub licensable right to use the Service during your use of our website for the purpose of viewing the content provided there by AMC Networks.
Without the prior written consent of AMC Networks, you may not use the license or Service for any other purposes than provided in these Terms and Conditions.
3. PROVIDING OF THE SERVICE
AMC Networks provides the Service (including the content accessible by means of the Service) 'as-is' without any guarantees. This means, amongst others, that AMC Networks does not warrant or guarantee:
(a) the availability, continuation, security and/or maintenance of the Service; and
(b) the accuracy, completeness and/or correctness of the content,
AMC Networks may terminate or withdraw the license or Service at any time, for cause or convenience, without giving prior notice and without being liable.
4. LIMITATION OF LIABILITY AMC NETWORKS
To the maximum extent permitted by Netherlands law, AMC Networks excludes all liabilities, representations and warranties relating to the subject matter of these Terms and Conditions. In any event, AMC Networks shall only be liable for reasonable and fair proven financial losses and damages as ordered by the competent court in Amsterdam, the Netherlands, and considering that the Service is provided free of charge.
For the sake of completeness, AMC Networks does not accept any liability for third party content or websites, including content or websites visited via hyperlinks provided by or not deleted by AMC Networks.
5. LIABILITY OF THE USER OF THE SERVICE
To the maximum extent permitted by Netherlands law, user will be held liable for any and all breaches of these Terms and Conditions, third-party claims, and infringements of applicable law, including without limitation to infringements of law applicable to the user's use of the Service and the content accessible by means of the Service).
6. SEVERABILITY
If any part of These Terms and Conditions is deemed by a competent court to be invalid, unlawful, inapplicable or unenforceable, this won’t affect the rest of these Terms and Conditions.
7. WAIVER OF RIGHTS
Any delay or failure to exercise a right or to enforce any of these provisions must not be interpreted as a waiver of our rights or remedies.
8. LAW AND JURISDICTION
These Terms and Conditions shall be governed by and construed in accordance with the law of the Netherlands. Any disputes relating to these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of Amsterdam, the Netherlands.
